1.1 Interpretation
Words with capitalized initial letters have meanings defined under the following conditions. These definitions have the same meaning whether they appear in singular or plural.
1.2 Definitions
For the purposes of these Terms of Service:
Account: A unique account created for You to access our Service.
Affiliate: An entity that controls, is controlled by, or is under common control with a party.
Application: The VISIT PULA software provided by the Operator.
Buyer: Users who place Orders for Goods.
Company: VISIT PULA, operated by CEN TOURS d.o.o., Trg slobode 2A, 52440 Poreč, Croatia, VAT: HR40135629362.
Content: Text, images, or other data available on the Service.
Device: Any device that can access the Service.
Feedback: Suggestions or comments submitted by You.
Goods: Items or services listed through the Service.
Operator: VISIT PULA / Stevo Žufić.
Order: A request by You to purchase or book Goods.
Seller: Users listing Goods or services.
Service: The Website and/or Application.
Terms: This agreement governing the use of the Service.
Third-party Social Media Service: External services integrated in the platform.

By accessing or using the Service, you agree to be bound by these Terms. You must meet the legal age of your country or Croatia, whichever is higher. If you do not agree, do not use the Service.
These Terms are governed by Croatian law.
EU consumers retain their statutory rights.
U.S. compliance: You must not be subject to sanctions.
Invalid terms will be modified but the rest remain valid.
Failure to enforce a right does not waive that right.
You must provide accurate information when creating an account.
Additional data may be required to complete transactions.
You are responsible for keeping your password secure.
We may suspend or terminate accounts at any time.
You are responsible for your own posted content.
Content must not be illegal, offensive, or misleading.
We will act on copyright complaints and may remove infringing content.
The platform is an intermediary; we are not a party to the transactions.
Valid payment and compliance with rules are required for orders.
Refunds depend on cancellation reason and party involved.
We disclaim all warranties to the fullest extent permitted by law. Our liability is limited to €100 or the amount you paid, whichever is lower.
8.1 User Responsibility
Vendors are solely responsible for their listings and customer communication. Visit Pula does not guarantee any number of inquiries, bookings, or results.
8.2 Consumer Protection
We reserve the right to inspect listings and take action if providers breach rules, laws, or fair business practices — including suspending or removing listings or accounts.
We encourage informal resolution. Legal disputes shall be resolved by Croatian courts.
All content on the Service remains the property of Visit Pula or its licensors.
We may change these Terms at any time. Continued use means you accept the new version.
(Applies only in cases where payment is processed through the VisitPoreč marketplace)
1. Role of the Platform as an Intermediary
In cases where the end customer (buyer) makes a payment for a service or product through the VisitPoreč platform (hereinafter: the Marketplace), and the funds are received in full by the Marketplace, this annex defines the rights and responsibilities of all involved parties.
The Marketplace acts solely as an intermediary (agent) between the service or product provider (hereinafter: the Vendor) and the customer. The Marketplace does not provide the service or product in its own name, but merely facilitates the agreement between the Vendor and the Customer. The Vendor is solely responsible for the performance of the service or delivery of the product.
2. Payment Flow and Commission
The Customer pays the full amount to the Marketplace. The Marketplace retains a pre-agreed commission and transfers the remaining amount without undue delay to the Vendor.
The commission is considered revenue of the Marketplace.
The remaining amount is considered revenue of the Vendor.
The Vendor issues an invoice to the customer for the full amount of the service or product. The Marketplace may issue an invoice to the Vendor for the commission amount.
3. Legal and Accounting Framework
This model is based on the International Financial Reporting Standard IFRS 15 – Revenue from Contracts with Customers, particularly paragraphs B34–B38, which clearly define the agent vs. principal model. The agent does not recognize the full payment amount as revenue, but only the commission earned.
4. Contractual Validity of this Annex
This annex has the effect of a contract between the Marketplace and the Vendor and is fully accepted upon registration to the platform when the payment method selected includes processing via the Marketplace. This annex does not apply to other types of payments processed directly between the Customer and the Vendor.
